LIST-4-LESS SELLER AGREEMENT
Please read the following agreement, then
AGREE AND CONTINUE TO ORDER
List-4-Less is a licensed real estate brokerage in the state of Georgia.
It is a Flat Fee Limited Service company. It does not provide the
same services as a "traditional" brokerage. Accordingly, you are
paying a reduced flat fee rather than the "traditional" percentage fee
typically charged by full-service brokerages.
Using the services of List-4-Less does not
create any agency or other relationship between you and List-4-Less. List-4-Less does not
actually represent you. List-4-Less submits the property to MLS, or any
comparable multiple real estate listing service, the order shall be
deemed earned by List-4-Less, shall be NON REFUNDABLE, and the
undersigned shall not receive a refund of any funds paid for the order.
The official code of Georgia, Section
10-6A-3(11) defines "Ministerial Acts" as those acts which a broker or
affiliated licensee performs for a person which does not require
discretion or the exercise of the broker of affiliated licensee's own
List-4-Less will provide such
Ministerial Acts as stated in the services list of the particular
product Seller purchases. Such acts may include one or more of the
following: submitting the information Seller provides to the multiple
listing service directory; providing Seller with pre-printed forms;
providing Seller with names of local lenders, inspectors, attorneys,
insurance agents, surveyors, and such other like or similar services.
In no way does List-4-Less promote or receive compensation from any
companies listed. None of the Ministerial Acts performed by List-4-Less
shall be construed in such a manner as to form a brokerage engagement
There have been isolated instances of
reported burglaries of homes on which lockboxes have been placed and for
which the lockbox has been alleged to have been used to access the home.
However, each access of the lockbox by a licensed real estate agent is
recommended, including the agent's name and the date and time of entry.
In order to minimize the risk of misuse, it is recommended lockboxes not
be attached to door handles that can be unscrewed from the outside, or
on other parts of the home from which the lockbox can be removed.
List-4-Less works to maintain its
website and services, but is not responsible for defects that may exist
within its website or any resulting loss of profits or other damage. List-4-Less
attempts to accurately enter the information Seller provides into the
multiple listing service. However, List-4-Less does not guarantee
error-free service. Seller is expected to review the multiple
listing service listing for Seller property; if any error is discovered
from Seller's review, Seller must promptly notify List-4-Less so that
the error may be remedied. List-4-Less is not responsible for any
loss of damage suffered by the error.
Seller agrees to submit an executed
contract to List-4-Less within 48 hours of signature by both parties,
and a settlement statement prior to closing, so that List-4-Less may
update the MLS. Failure to do so will result in a fine by the MLS
to List-4-Less, which will be charged through to the Seller.
Georgia Real Estate Commission has
determined that homeowners, unless licensed by the company on the real
estate sign, may not advertise their name and number on the yard sign.
Georgia Real Estate Commission's interpretation of the Georgia Law is
that this is practicing real estate without a license.
If a yard sign is damaged, the Seller
agrees to pay a $50 yard sign shipping and handling fee. Seller hereby
releases List-4-Less and those working through List-4-Less from all
liabilities and responsibility in connection with any loss that may
You are responsible for complying with
any subdivision, city, county, and state requirements in regards to
signage laws, ordinances or restrictions. Should you be guilty of
violating any laws, ordinances or restrictions, any resulting citations,
fines or levies will be your responsibility.
* There is a $25.00 fee payable to both
FMLS & MLS and a $10.00 administrative fee payable to List-4-Less to
terminate or withdraw your home's listing prior to its expiration date.
* Seller agrees to pay List-4-Less a fee
of .0012 of the sales price at closing to cover the FMLS listing fee.
List-4-Less shall under no
circumstances have any liability greater than the amount it received
from Seller for its services. Seller agrees to hold List-4-Less
harmless for any and all claims, causes, or damages arising out of or
relating to Seller providing incomplete and / or inaccurate information
List-4-Less is a Georgia Corporation and its
services are intended for use only by persons located in Georgia.
*When a property is listed by a principal
member and a contract presented within 90 (ninety) days after expiration
is accepted, providing the purchaser was introduced to the property
prior to its expiration, a fee shall be due to FMLS from the selling and
listing principal member as described above when the property closes.
